Dear Senator,
I am writing to you today as an advocate for harm reduction alternatives to tobacco and as a South Dakotan consumer with a presumed freedom of choice. As such, I urge you and your fellow Senators to vote no on HB1069.
HB1069 has been promoted under the guise that it will protect the health of South Dakota’s vapors, but that is a façade. HB1069 only exists to protect the interests of Big Tobacco, which conveniently owns the only vapor products that the FDA has approved via the PMTA process. Why should Big Tobacco get to win at the expense of small businesses? Why should South Dakota consumers put their faith in the FDA, which has demonstrated utter bias in their determinations thus far? Until the regulatory bodies can prove competence and objectivity in their evaluations of vapor products, a bill such as HB1069 has no place in South Dakota law.

Dear Senator,
I am writing as a voter and taxpayer in South Dakota urging you to reject HB 1069, which would force the state to enforce the FDA’s disastrous anti-vaping regulations. If this legislation is enacted, I and thousands of people like me in South Dakota will lose access to smoke-free products that are helping us live smoke-free lives. To be blunt, support for these bills is sacrificing the lives of people who smoke in the name of protecting a tobacco company’s share of the nicotine vapor market--not protecting youth or public health.
The FDA is failing to regulate smoke-free nicotine products in a way that protects public health. The federal regulator’s delay in decision making and arbitrary denial orders are also bogging the agency down with the lawsuits and reputational damage. Enforcing a de facto ban on products that FDA is supposed to be reviewing will come at the expense of South Dakota taxpayers and public health.
Please reject HB 1069 and thank you for listening to my comments. I, and my fellow members of the Consumer Advocates for Smoke-free Alternatives Association appreciate your time and look forward to your response
